What to do if you receive a Criminal Charge:  Please be aware that if you do absolutely nothing it will result in you being tried in your absence, you will risk being found guilty (which creates a permanent criminal record), and a Bench Warrant being issued for your arrest.  Once you are picked up on the warrant you will have to remain in jail until someone pays your fine in full – and “Yes” we will notify your hometown or college law enforcement agency.

  1. PAY THE FINE NOTED ON YOUR TICKET –  You can pay your fine:
    1. over the phone with a debit/credit card (Visa or MasterCard only),  a 6%  processing  fee will be assessed, or
    2. via certified check or money order through the mail (payable to the City of Camden), or
    3. In-person at the Clerk of Court office with cash or debit/credit card (Visa or MasterCard only), a 3% processing fee will be assessed, do not mail cash.
  2. UTILIZE A DIVERSION PROGRAM   Once you have completed a Diversion Program the arrest and all associated data will be expunged from your record.  To apply for one of these programs you must contact the local Solicitor’s office.
    1. There are two types of diversion programs: Note: Not everyone is qualified to participate in a diversion program
    2. Alcohol Education Program (AEP) for defendants 17-20 years old at the time of arrest.  (DUI is not allowed)

  3. REQUEST A TRIAL :
    1. Bench Trial – this involves appearing before the Court and to represent yourself, or have an attorney
      1. (an attorney that you have hired on your own) to represent you.  The Judge will then determine your guilt or innocence and pass judgment, if applicable, or
    2. Jury Trial – this involves presenting your case before a jury, made up of citizens of the Camden community, who will determine your innocence or guilt, after which time the judge will either release you (if innocent) or pass sentence on you (if guilty).  It is recommended that you utilize an attorney in a jury trial, but you may also represent yourself.

    Something to consider:

    • Alcohol violation convictions for persons under 21 may result in the suspension of your driver’s license, even though you are convicted in South Carolina and your license is from another state.  
    • If you are currently enrolled in college (or plan to be in the future), a criminal charge on your record may result in the loss of various types of financial aid or scholarships.  
    • You will have a permanent criminal record until, or unless, you file to have the record expunged, but this can occur only after three years have passed.  A permanent criminal record may deter prospective employers from hiring you and, in some cases, may result in the loss of a currently held job(s).
